Terms of Service
Please read these Terms of Service ("Terms", "Agreement") carefully before using the NearTeach mobile application ("Application", "App", "Platform") operated by NearTeach ("Company", "we", "us", "our"). By accessing or using the Application, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use the Application.
1. Acceptance of Terms
By downloading, installing, accessing, or using the NearTeach Application, you represent that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations of India. These Terms constitute a legally binding agreement between you and NearTeach. Your continued use after any modifications constitutes your acceptance of the revised Terms.
2. About NearTeach
NearTeach is a hyperlocal digital platform that connects students and parents with home tutors in their vicinity. The Application facilitates discovery, communication, and confirmation of tutoring arrangements between independent tutors and students or their parents. NearTeach is a technology platform and connection service—not a tutoring agency, educational institution, or employer of tutors. The relationship formed through the Platform is between the tutor and the student or parent; NearTeach is not a party to that relationship.
3. Eligibility and User Accounts
3.1 Eligibility
You must be at least thirteen (13) years of age. If under eighteen (18), you must have parent or legal guardian consent.
3.2 Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.
3.3 Account Responsibility
Notify NearTeach immediately of any unauthorised use. You may not share or transfer your account. Each user may maintain only one account.
3.4 Account Accuracy
All profile information must be truthful and accurate. Providing false or misleading information may result in immediate suspension or termination without refund.
4. User Roles
Tutors are independent individuals who offer tutoring services. They are not employees or agents of NearTeach. Students and parents are responsible for due diligence and ensuring the safety of minors during tutoring arrangements.
5. Platform Services
Discovery is based on geographic radius (1 km, 3 km, or 5 km). In-app chat must be used until a match is formally confirmed—sharing personal contact information before confirmation violates these Terms. The Application provides a facility for free online introductory meetings before confirmation. Upon mutual confirmation, a one-time confirmation fee is charged to each party. Verification badges are offered at NearTeach's discretion and do not constitute an endorsement.
6. Subscription Plans and Payments
Subscription plans determine geographic search radius. Payments are processed through Razorpay. Subscription fees are non-refundable after seven days. Confirmation fees are non-refundable once both parties have confirmed. Payment disputes between tutors and students are exclusively between those parties; NearTeach accepts no liability. Unpaid confirmation fees may result in account restriction.
7. Prohibited Conduct
You agree not to: create false or misleading profiles; share personal contact information in chat before confirmation; harass or threaten other users; post unlawful or objectionable content; circumvent the payment system; create multiple accounts; use the Platform for purposes other than tutoring; gain unauthorised access; or violate applicable Indian law.
8. Account Suspension and Termination
NearTeach may suspend or terminate your account at any time for violations, harmful conduct, or at its discretion. Upon termination, your right to access ceases immediately. Unused subscription periods are forfeited without refund. Reinstatement may be subject to a fee. You may terminate your account at any time through account settings; termination does not entitle you to a refund.
9. Intellectual Property
The NearTeach Application, including its name, logo, design, and features, is the exclusive intellectual property of NearTeach. You retain ownership of your content but grant NearTeach a non-exclusive licence to use it on the Platform. You may not copy, modify, distribute, or create derivative works without prior written consent.
10. Disclaimer of Warranties
The Application is provided "as is" and "as available" without warranties of any kind. NearTeach does not warrant uninterrupted, error-free, or virus-free operation. NearTeach makes no warranty regarding the quality, suitability, safety, or legality of any tutor or their services.
11. Limitation of Liability
To the maximum extent permitted by law, NearTeach shall not be liable for indirect, incidental, special, consequential, or punitive damages. NearTeach's total liability shall not exceed the amount you paid in the thirty days preceding the claim. NearTeach is not liable for disputes, injuries, or damages arising from arrangements between tutors and students.
12. Indemnification
You agree to indemnify and hold harmless NearTeach from any claims, damages, or expenses arising from your use of the Application, your violation of these Terms, or your conduct in connection with a tutoring arrangement.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India. Before initiating legal proceedings, contact NearTeach at nearyou.teach@gmail.com to attempt informal resolution.
14. Changes to These Terms
NearTeach may modify these Terms at any time. Material changes will be notified via the Application or email. Your continued use after the effective date constitutes acceptance.
15. Miscellaneous
If any provision is invalid, the remaining provisions continue in effect. These Terms constitute the entire agreement between you and NearTeach.
